Risk Statement
It must be recognised that boating is by its nature an unpredictable sport and therefore inherently involves an element of risk. By taking part in a course/session, you agree and acknowledge that:
- (i) You are aware of the inherent element of risk involved in the sport and you accept responsibility exposing yourself to such inherent risk whilst taking part in the Event;
- (ii) You will comply at all times with the instructions of the Organiser, particularly with regard to handling of boats, wearing of buoyancy aids and the wearing of suitable clothing for the conditions;
- (iii) You accept responsibility for any injury, damage or loss to the extent caused by your own negligence;
- (iv) You will not participate in the Event if under the influence of alcohol, drugs or if otherwise unfit to participate OR;
- (v) The provision of patrol boat cover is limited to such assistance, as can be practically provided in the circumstances;
- (vi) You have satisfied yourself as to your suitability for the course you are attending
- (vii) You will inform the organiser if there have been any changes to the information provided on the booking form at the time of the Event.
Course Cancellation
In the event that unforeseen circumstances mean that a course cannot take place in whole, all fees paid will be returned. Where courses have to be adapted, but not cancelled, no refund will be given.
Minimum Age
The minimum age for a child who wishes to attend an LRSS course is 10 years old. The child must be 10 years old or over on the first day of the course. Any participant found in breach of this may be removed from the course, without refund, at the disgression of the Senior Instructor in charge.
Reservation of Places
Places are reserved through our WebCollect system. You must pay within one week of booking the place. Payment details are given at the time of booking. All payments must be accompanied by the appropriate bank transfer reference, which is given at the time of booking. The transaction is not complete until payment has been made, and may be cancelled if the payment is not made within the one week timeframe.
Lyme Regis Sailing Club
Lyme Regis Sailing Club and Lyme Regis Sea School are separate organisations. Membership of one organisation does not give membership of the other, i.e. if you are a Sailing Club member and wish to use Sea School facilities or join a course, then you must become a Sea School member.
You are only eligible to use the Lyme Regis Sailing Club facilities for the duration of the course on which you are enrolled.
Refund Policy
Membership fees are not refundable.
The entire course fee is not refundable, as a proportion of each course consists of relevant shore based activities.
A pro-rata refund will be offered on Intensive Courses if it is not possible for relevant acceptable activities to take place on a given day, e.g. bad weather precludes further sailing and no related shore based activities can be realistically offered.
Whenever possible, alternative sessions will be offered to compensate for missed sessions instead of a refund.
Refunds will not be given for students’ disinclination to continue with, or start, a course. However, where a student gives adequate notice so that LRSS is able to fill their place with another paying customer, a refund may be given.
- Where a course space can be filled with another paying customer, a full refund will be given, less a £25 administrative fee.
- Where notice is short, or a course/session is bespoke for a customer (therefore not not possible to fill), no refund will be given.
- Where it is doubtful whether the space will be filled, LRSS may choose to offer a part or full refund dependent on the circumstances of the case, less a £25 administrative fee.
All refund requests will be dealt with on an individual basis and the above guidelines are not rigid.
Sea School Membership
You are a member by virtue of booking a course with us – membership requires no action from you.
Your conduct on courses
For our safety and the overall harmony within the team and among our customers, we will ask customers to leave a course or session with us under certain circumstances. The below list gives an indication of behaviours likely to result in the termination of our contract with you, but is not exhaustive. Any decision taken is at the discretion of the Instructor in charge of the session. Decisions may be appealed through the Chief Instructor, Principal or Trustees.
They behave in a way likely to endanger themselves or others purposefully;
They do not desist from risky or unacceptable behaviours upon request from a member of staff;
They are under the influence of alcohol or drugs during course hours.
Changes and alterations to these Terms and Conditions
Alterations may be made to these terms and conditions at any time, at the discretion of LRSS. No alteration will result in the termination of our contract with you, or the delivery of a significantly different product. Alterations are generally made to ensure the continuous and sustainable function of the charity.
